“Drawing Boxes” – Peak Adventure Days Promotion

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST.  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  VOID WHERE PROHIBITED BY LAW.

 

1. Eligibility

 

Drawing boxes (“the Promotion”), part of Peak Adventure, is open to patrons who are at least 18 years of age and who are authorized by Department of the Air Force Instruction 34-101 (DAFI), Department of the Air Force Morale, Welfare, and Recreation Programs and Use Eligibility, dated 7 March 2022, Attachment 2.  Force Support Squadron (FSS) Leadership (Commander, Deputy and Senior Enlisted), FSS Flight Chiefs, FSS Managers, FSS Assistant Managers, FSS Marketing Staff, Nonappropriated Fund Accounting Office employees, immediate families of the above (spouse, children, parents, and siblings), and household members of the above are not eligible to participate in the Promotion.  FSS employees may not participate or win at the activity where they work. 

 

2. Agreement to Rules

 

By participating, participants agree to be fully unconditionally bound by these Rules.  Participants represent and warrant that they meet the eligibility requirements.  In addition, participants agree to accept the decisions of Peterson SFB Morale, Welfare and Recreation Fund (PSFB MWR) as final and binding as it relates to the content of this Promotion.

4. Entry Period

 

The Promotion begins on July 11, 2021 at 5:00 a.m. Mountain Daylight Time (“MDT”) and ends on July 24, 2021 at 4:00 p.m. MDT (the “Promotion Period”).  Multiple manually entered entries are permitted, however, Sponsor expressly reserves the right to disqualify any entries that Sponsor believes in good faith are fraudulent.  The Contest is comprised of one (1) entry period (“Entry Period”).

 

• One (1) – All-Terrain Vehicle (ATV)(“the Grand Prize”) valued at $9,841
• One (1) – $2,000 of credit to be used at Outdoor Recreation (ODR), Information, Tickets, and Travel (ITT), or Leisure Travel, value $2,000
• One (1) – $1,000 credit to be used at ODR, ITT, or Leisure Travel, value $1,000
• One (1) – $500 credit to be used at ODR, ITT, or Leisure Travel, value $500
• One (1) – ODR Whitewater Rafting Trip for six (6) valued at $510
• One (1) – Kayak valued at $399
• One (1) – Yeti Cooler valued at $250

Participants are eligible for one prize per household.

 

5. Entry Requirements

 

1. During the Promotion Period, drawing boxes will be placed in FSS facilities on Peterson Space Force Base (SFB).  Aquatics Center, Fitness Center, Library, MPF, A&FRC, ODR, Bowling Center, The Hub and the DFAC.

 

1. Eligible participants (see section 1) can enter their name along with their contact information in the drawing box.  Entries are limited to one per person, per day. 

 

Any questions, comments or complaints regarding the Promotion must be directed to Sponsor/Administrator.  By participating, each Participant warrants and represents that all personal information provided in conjunction with their participation is truthful, current and accurate and is their own information.   Entry information becomes the exclusive property of Sponsor upon submission.  Potential Winners may be required to show proof of eligibility.

 

6. Selection and Notification of Winners

 

Peterson SFB Morale, Welfare and Recreation Fund (PSFB MWR Fund) is an independent organization whose decisions as to the administration and operation of the Promotion and the selection of potential Winners are final and binding in all matters related to the Promotion.  PSFB MWR Fund will select Winners from the applicable Entry Period on Monday, 25 July 2022.  An eligible entry will be a submission to one of the drawing boxes at 21 FSS facilities with an eligible winner’s name and contact information including phone number.  The Winner will be selected by a random drawing under the supervision of 21st Force Support Squadron.  Winners will be notified on July 25, 2022, following selection of Winner.  The potential Winners will be notified by the Sponsor via the phone numbers that will be required to be put on an entry slip.  If a drawn entry slip in unintelligible, if the Winner cannot be contacted, is ineligible, fails to claim the prize within 48 hours from the time of the first phone call in which the potential winner was spoken with, a message was left with the person answering the phone, a voicemail message was left, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected.  Receipt by the Winner of the prize offered in this Promotion is conditioned upon compliance with any and all federal, state, and local laws and regulations. 

 

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.  A PARTICIPANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE CONTEST SHOULD SO INDICATE, UNLESS AND UNTIL PARTICIPANT’S ELIGIBILITY, AND THE CONTEST WINNER HAS BEEN VERIFIED AND PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.  SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.

 

WINNERS, OR THEIR DESIGNATED APPOINTEE IF WINNER CANNNOT ATTEND, MUST BE PRESENT AT FINAL FRIDAY AT PETERSON SFB, COLORADO ON JULY 29, 2022.  

 

7. Verification of Potential Winners

 

Receiving a prize is contingent upon compliance with these Official Rules.  The potential Contest Winners will be notified by Sponsor via the telephone number provided on the entry slip.  The potential Winner must claim their prize within 48 hours after the date of notification.  It is the potential Winner’s responsibility to answer their phone or to check their voicemail messages.  If the potential Winner fails to respond to the prize notification within the specified 48 hours, the potential Winner will forfeit the prize.  In the event of a dispute regarding the identity of the person submitting the entry, the entry will be deemed to be submitted by the person in whose name the phone number provided is registered.  There will be alternate drawings until the prize is awarded.

 

8. Prizes and Prize Redemption

 

The Contest prizes are as noted in the table in Section 4.  Odds of winning the Contest prize depends on the number of participants per day during the Entry Period.  The odds of winning depend on the number of eligible entries received.  Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.  Winners are responsible for all federal, state and local taxes, and fees, associated with prize receipt and/or use.  Limit:  one (1) entry per person per day.  TOTAL APPROXIMATE RETAIL VALUE OF ALL PRIZES: $13,650.  Actual/appraised value may differ at the time of prize award.  No cash or other prize substitution shall be permitted except at the discretion of Sponsor.  The prize is nontransferable.  No more than the advertised number of prizes will be awarded.  All prizes offered are being provided “as is” with no warranty or guarantee by Sponsor, either express or implied.  No transfer, substitution, upgrade, credit, refund, or cash equivalent for the prize is allowed except at Sponsor’s sole discretion.  

 

9. Release

 

By participating in the Contest and/or receiving a prize, Winner agrees to release, indemnify, and hold harmless Sponsor/Administrator, Prize Patrons and their respective subsidiaries, affiliates, suppliers, distributors, advertising/Promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.

 

10. Publicity

 

Except where prohibited by law, the Winner’s entry and acceptance of the prize constitutes Winner’s permission for the Sponsor and those acting under its authority to use said Winner’s name, photograph, likeness, statements, biographical information, voice, and address (city and state only) on a worldwide basis, and in all forms of media, in perpetuity, for advertising or Promotional purposes without review or further compensation.

 

11. General Conditions

 

Sponsor reserves the right to suspend or cancel the Promotion or modify these Official Rules as necessary for any reason or as required by applicable law.  In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries.  Sponsor reserves the right, in its sole discretion, to disqualify from the Promotion, and ban from any future Promotions, any person it believes to have intentionally violated these Official Rules, or to be acting in an unsportsmanlike, deceptive, or disruptive manner, or to have tampered with any element of the Promotion without notice to the disqualified or banned person.

 

12. Limitations of Liability

 

The Released Parties are not responsible for:  (a) any incorrect or inaccurate information, whether caused by Participants, printing errors, or by any of the equipment or programming associated with or utilized in the Promotion;  (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;  (c) unauthorized human intervention in any part of the entry process or the Promotion;  (d) technical or human error which may occur in the administration of the Promotion or the processing of entries;  or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Promotion or receipt or use or misuse of any prize.  If for any reason a Participant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant’s sole remedy is another Contest entry, if possible.

 

13. Disputes

 

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of Entrants and Sponsor in connection with the Promotion shall be governed by and construed in accordance with the laws of the State of Colorado without giving effect to any choice of law or conflict of laws rules or provisions.  Any legal claims arising out of or relating to the Promotion or these Official Rules must be brought in the federal or state courts located in Denver, CO.  Except where prohibited, Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket cost expenses , (i.e. costs associated with entering this Contest), but in no event attorneys’ fees; and (c) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
